Family Residence Permit (maximum 3 year Residency Permit)





What is a family residence permit FRP (aile ikamet izni)?
A FRP covers the family members of a ‘sponsor’.  A sponsor can be either a Turkish citizen, a former Turkish citizen (holder of a Blue Card mavi kart), a foreigner with a valid work permit or a foreigner who has had at least one year of residency and whose residence permission continues. The duration of the family residence permit can under no circumstances exceed the duration of the sponsor’s residence permit.

Which family members are covered by the FRP?
a) Foreign spouses (only legally married)
b) foreign children of sponsor or foreign minor children of their spouse;
c) dependent foreign children of the sponsor or dependent foreign children of their spouse (even over 18 years of age);

Requirements if FRP shall just be issued for children of sponsor
a) If the minor child(ren)’s other parent lives abroad and shares custody, a written consent (notarized, apostilled, notarized Turkish translation) must be presented.
b) If the other parent is dead a death certificate must be presented
c) If the sponsor holds custody for the minor child(ren), the related court decision must be presented (if from abroad, with apostille and notarized Turkish translation)

Applying for FRP – required documents

From the spouse:
Signed application form
4 recent biometric 5x6cm sized photos
Original passport and coloured photocopy
Marriage certificate (original and photocopy of first 3 pages, if issued abroad apostille stamp and notarized Turkish translation)

From the child:
Application form for each child
4 recent biometric 5x6cm sized photos
Original passport and coloured photocopy
Birth certificate (if issued abroad apostille stamp and notarized Turkish translation)

From the sponsor:
Original and photocopy of identity document
Proof of sufficient and regular income for the duration of stay
Valid health insurance covering all family members
Criminal record check (Adli sicil kaydı from Turkish district courts or e-devlet portal if sponsor is Turkish or has lived in Turkey for more than 5 years, otherwise document from abroad must be presented)
Address document (Yerleşim belgesi) from the local Nüfus Müdürlüğü or muhtar or e-devlet portal
Nüfus Kayıt Örneği (Record of public registration) if the sponsor is a Turkish citizen
Note:
The sponsor must attend the appointment together with the applicant(s)
Every applicant must have their own tax number (even a baby)
What is considered as sufficient income: For a 3-person household the sponsor must provide proof of income/assets equal to the minimum wage. If there are more than 3 persons (including the sponsor) the income cannot be less than the minimum wage plus 1/3 of the minimum wage for each extra family member (1.500 TL per month for a 3-person household plus 500 TL for every additional member).

Fees:
Fees depend on the nationality of the applicant. Some nationalities are exempt of residency fees if they are spouses of Turkish citizens, but everyone must pay the card fee (63 TL). Children are usually subject to 50% of the adult residency fee.

Transfers to other types of residence permit:
- Family residence permits shall entitle the holders the right to education in primary and secondary educational institutions until the age of 18 the without obtaining a student residence permit.
Any person reaching the age of 18 who has resided in Turkey on a family residence permit for a minimum of three years immediately prior to reaching their 18th birthday may, upon application, transfer to a short-term residence permit-
- In the event of divorce, a short-term residence permit may be issued to a foreign spouse of a Turkish citizen, on the condition that he or she resided on a family residence permit for at least three years. However, in cases where it is established by the relevant court that the foreign spouse has been a victim of domestic violence, the condition for three years of residence shall not be sought.
- In the event of the death of the sponsor, a short-term residence permit may be issued without any [minimum residing] time condition attached to those who have resided on a family residence permit associated with the sponsor.
